Paopao Terms of Service

These Terms of Service ("Terms") govern your use of the Paopao mobile app and website at joinpaopao.com (together, the "Service"). The Service is operated by Paopao ("Paopao," "we," "us," or "our").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and accounts

• You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the permission of a parent or guardian.
• You must provide accurate information when creating an account and keep it up to date.
• You are responsible for keeping your login credentials and device secure and for all activity under your account. Tell us right away at hello@joinpaopao.com if you suspect unauthorized use.
• We may suspend or terminate accounts that violate these Terms.

2. SMS text messaging terms

When you provide your mobile phone number, Paopao will send you a one-time verification code by SMS to confirm your number. By entering your phone number and requesting a code, you consent to receive that message.

• Message frequency: varies based on your activity; typically one message per sign-up or login attempt.
• Message and data rates may apply. Check with your carrier for details.
• Opt out: reply STOP to any message to stop receiving texts from Paopao. After you reply STOP, we will send one final message confirming you have been unsubscribed. Note that opting out may prevent you from verifying your phone number and using features that require it.
• Help: reply HELP to any message, or email hello@joinpaopao.com, for assistance.
• Supported carriers: major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
• Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.

3. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Post false, misleading, or fraudulent information, including fake event listings or RSVPs.
• Impersonate any person or entity.
• Scrape, crawl, or copy the Service or its content without our written permission.
• Interfere with the Service's security or operation, or attempt to access accounts or systems without authorization.
• Use the Service to send spam or unsolicited messages.

4. Content

• Your content: you keep ownership of anything you post to Paopao (such as profile details or event reviews). You grant Paopao a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content as needed to operate and promote the Service.
• Our content: the Service, including its design, code, logos, and text, is owned by Paopao or its licensors and protected by intellectual property laws. You may not copy or reuse it except as allowed by these Terms.

5. Disclaimers

Running and other athletic activities carry inherent risks. You are responsible for your own health and safety and for deciding whether an event is appropriate for you.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT EVENT INFORMATION WILL BE ACCURATE OR COMPLETE.

6. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PAOPAO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR PARTICIPATION IN ANY EVENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PAOPAO IN THE 12 MONTHS BEFORE THE CLAIM OR (B) $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

7. Indemnification

You agree to defend, indemnify, and hold harmless Paopao from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, your participation in any event, or your violation of these Terms.

8. Termination

You may stop using the Service or delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including 4, 5, 6, 7, and 9) will survive.

9. Governing law and disputes

These Terms are governed by the laws of the United States and, to the extent applicable, the laws of the state in which Paopao is established, without regard to conflict-of-law rules.

Before filing a claim, you agree to contact us at hello@joinpaopao.com and give us a reasonable opportunity to resolve the issue informally.

10. General

If any part of these Terms is found unenforceable, the rest remains in full effect.
